{"id":3613,"date":"2010-12-27T03:10:20","date_gmt":"2010-12-27T11:10:20","guid":{"rendered":"http:\/\/www.truckaccidentlaw.org\/blog\/?p=3613"},"modified":"2013-03-15T11:09:35","modified_gmt":"2013-03-15T18:09:35","slug":"fmcsa-issues-notice-of-proposed-rulemaking-for-total-ban-on-cell-phone-usage","status":"publish","type":"post","link":"https:\/\/www.truckaccidentlaw.org\/blog\/3613\/fmcsa-issues-notice-of-proposed-rulemaking-for-total-ban-on-cell-phone-usage\/","title":{"rendered":"FMCSA Issues Notice Of Proposed Rulemaking for Total Ban on Cell Phone Usage"},"content":{"rendered":"<p>WASHINGTON DC &#8211; On Tuesday, December 21, 2010 the Federal Motor Carrier Safety Administration <a href=\"http:\/\/www.fmcsa.dot.gov\/rules-regulations\/administration\/rulemakings\/proposed\/Mobile_phone_NPRM.pdf\" target=\"_blank\">FMCSA<\/a> called for a notice of proposed rulemaking (NPRM) that would ban the use of hand-held mobile devices by commercial drivers of motor vehicles (CMVs).<\/p>\n<div id=\"attachment_3625\" style=\"width: 490px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-3625\" class=\"size-full wp-image-3625\" title=\"semi-truck-cell-phone-ban\" src=\"http:\/\/www.truckaccidentlaw.org\/blog\/wp-content\/uploads\/2010\/12\/semi-truck-cell-phone-ban.jpg\" alt=\"\" width=\"480\" height=\"320\" srcset=\"https:\/\/www.truckaccidentlaw.org\/blog\/wp-content\/uploads\/2010\/12\/semi-truck-cell-phone-ban.jpg 480w, https:\/\/www.truckaccidentlaw.org\/blog\/wp-content\/uploads\/2010\/12\/semi-truck-cell-phone-ban-150x100.jpg 150w, https:\/\/www.truckaccidentlaw.org\/blog\/wp-content\/uploads\/2010\/12\/semi-truck-cell-phone-ban-300x200.jpg 300w\" sizes=\"auto, (max-width: 480px) 100vw, 480px\" \/><p id=\"caption-attachment-3625\" class=\"wp-caption-text\">Proposed ban on hand-held devices by commercial vehicle drivers<\/p><\/div>\n<p>This recent NPRM goes against the advice of the National Transportation Safety Board (NTSB) earlier this year.<!--more--><\/p>\n<p>The new proposal has not yet completely ruled out the use of hands-free devices but is asking the public for comments on whether or not the new rules should ban them along with hand-held devices.<\/p>\n<p>The FMCSA&#8217;s reasoning for the new NPRM is expressed by the following quote from their proposal:<\/p>\n<blockquote><p>Using a hand-held mobile telephone may reduce a driver\u2019s situational awareness, decision making, or performance; and it may result in a crash, near-crash, unintended lane departure by the driver, or other unsafe driving action.<\/p><\/blockquote>\n<p>Under the new NPRM drivers conducting interstate commerce would be forbidden to use any hand-held device such as a cell phone while operating a commercial vehicle.<\/p>\n<p>In addition, the new proposal would:<\/p>\n<ul>\n<li>Disqualify a trucker from driving a CMV if he or she is found guilty of a state or local traffic law or city ordinance prohibiting or restricting the use of a hand-held device while driving a commercial vehicle.<\/li>\n<li>The disqualification would remain in effect for 60 days after a second conviction and for 120 days after three or more subsequent convictions within a three-year period.<\/li>\n<li>It would add to its list of &#8220;serious&#8221; traffic offenses any state law, local law or ordinance that would prohibit or restrict the use of any hand-held or mobile device while driving.<\/li>\n<\/ul>\n<p>Through this rulemaking process, the government is asking the public for comments and would consider new and innovative technology if it was safe to use by commercial vehicle drivers.<\/p>\n<hr \/>\n<p>Published by <a title=\"Houston truck accidentlawyer\" href=\"http:\/\/www.truckaccidentlaw.org\/Southeastern-Texas.shtml\" target=\"_blank\">Houston truck accident lawyer<\/a> Gordon, Elias &amp; Seely, LLP<\/p>\n","protected":false},"excerpt":{"rendered":"<p>WASHINGTON DC &#8211; On Tuesday, December 21, 2010 the Federal Motor Carrier Safety Administration FMCSA called for a notice of proposed rulemaking (NPRM) that would ban the use of hand-held mobile devices by commercial drivers of motor vehicles (CMVs).
