GENERAL
ALLEGATIONS:

On April 30, 2010 Defendant, James C. Fore, III was traveling northbound on Arkansas Highway 59 South at its intersection with Riggs Drive. Plaintiff was traveling southbound on Arkansas Highway 59 South and was attempting a left turn onto Riggs Drive eastbound. Plaintiff attempted her turn in accordance with a green left turn traffic signal. Defendant, James C. Fore, III did not yield to the plaintiff and struck her vehicle in the right side by the left front. Plaintiff’s vehicle was pushed from the intersection and off the east side of the roadway and through the ditch line, coming to rest approximately 180 feet from the point of impact. The tractor/trailer rig operated by the Defendant continued through the intersection, off the east side of the roadway, and through the ditch line, coming to rest approximately 130 feet from the point of impact.

PLAINTIFF:

Plaintiff is a 22 year old college student that is disabled due to the subject incident. She is a resident of Van Buren, Arkansas.

DEFENDANTS:

MILLER TRUCK LINES, L.L.C. is an Oklahoma corporation whose principle place of business is in Stroud, Oklahoma.

James C. Fore, III is an individual residing in Sulphur, Oklahoma.

COMMENTS:

The defendant driver, James C. Fore, III was employed by MILLER TRUCK LINES, L.L.C. at the time of the subject incident. MILLER TRUCK LINES, L.L.C. has been sued under the legal doctrine of respondeat superior.
