Holding Drivers and Trucking Companies Accountable for Trucking Accidents

Truck drivers work long hours and are often pressured by their employer to complete their tasks by any means necessary. That results in shortcuts that amount to negligence. Drivers are required to adhere to regulations involving time on the road, number of breaks, and weight of the load they carry. Under the law, a trucking company can be held liable for the negligence of its drivers.

They also occur on State roads such as 112, 113, 110, 108, 109, 103, 401, 122, 503, 500, 14, 142, 22, 124, 125, 126, 128, 25, 26, 27, 231, 20, 31, 153, 542, 546, 547, 539, 167, 16 and 512.

The interstates go through Washington Counties as follows:(1) Interstate-90 generally travels east to west and goes through Spokane, Lincoln, Adams, Grant, Kittitas and King Counties;(2) Interstate-82 travels through Benton, Yakima and Kittitas Counties; and (3) Interstate-5 travels south to north and runs through Whatcom, Skagit, Snohomish, King, Pierce, Thurston, Lewis, Cowlitz, and Clark Counties. The remaining counties of Asotin, Chelan, Clallam, Columbia, Douglas, Ferry, Franklin, Garfield, Gran, Grays Harbor, Island, Jefferson, Kitsap, Klickitat, Mason, Okanogan, Pacific, Pend Oreille, San Juan, Skamania, Stevens, Wahkiakum, Walla Walla and Whitman have US2, US97, US195, US101 or 97 running through them. Catastrophic Injuries When Safety Was Not a Priority

It does not matter what kind of truck is involved in your accident. They can include:

  • Tanker Trucks - Oilfield Trucks- Pipe Haulers- Chemical Trucks and other trucks with trailers carrying hazardous materials
  • Slow Moving - Log Trucks, Garbage Trucks, Dump Trucks, Cement Trucks, Gravel Trucks and Construction Zone Trucks entering and exiting a highway construction zone, Wide-Load Convoys, Bulldozers, Farm Equipment and slow moving Paving Equipment
  • Freight Liners, UPS, DHL, Fed-Ex, U-Haul, Mayflower and other van lines
  • Shuttle Bus, Casino Buses to and from 7 Cedars, Red Wind, Lucky Eagle and Little Creek, Vacation Bus, Tour Bus, Greyhound Buses
  • Most all other 18-wheeler, Big-Rig, Flatbeds, Tractor/Trailer combinations or any type truck that involves a pre-trip inspection.

Commercial Trucks Not Large In Size But With A Large Insurance Policy

The difference in size of cash settlements in commercial truck cases are potentially much larger than auto to auto accidents generally for one reason: the size of the policy of insurance. Your personal auto policy is sometimes as low as the Washington state mandatory minimum limits require of $25,000, however, a commercial vehicle, such as a company van, pick-up, tow truck, etc., usually carries policies of insurance coverage with much higher limits and you can be fairly and fully compensated when the driver is negligent.

WASHINGTON FEE AGREEMENTS OR OTHER STATES' FEE AGREEMENTS

You do not have to retain a firm in Washington if the accident occurs in Washington. In the final analysis, you need to retain a firm that specializes in truck accidents. Often times, firms from other states, such as ours, are retained because of their experience and knowledge. The state of Washington requires that the client be ultimately responsible for the expenses in a contingency fee case win, lose or draw. Other states, such as Texas for instance, permit lawyers to have what is a true contingency fee contract, i.e., if there is no recovery, then the client pays no fees or any expenses. Because a truck accident usually has multi-states involved with, for example, a truck driver and/or truck company from another state other than Washington, the usage of a pure contingency fee contract is possible in some instances because other state's counsel are involved.
